THIS WEBPLATFORM AND SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CAMPING TOOLS DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A MERCHANT OR ANY THIRD PARTY THROUGH THE SERVICE OR ANY HYPERLINKED WEBSITE OR SERVICE, AND CAMPING TOOLS WILL NOT BE A PARTY TO OR IN ANY WAY MONITOR ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.

FEDERAL LAW, SOME STATES, AND OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION AND LIMITATIONS OF CERTAIN IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. THE DISCLAIMERS AND EXCLUSIONS UNDER THIS AGREEMENT WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU VOLUNTARILY ASSUME ALL RISKS ARISING FROM YOUR USE OF THE SERVICE, ITS CONTENT, AND ANY ACTIVITY OR PRODUCT YOU CHOOSE TO USE OR UNDERTAKE IN RELIANCE ON IT.

THIRD-PARTY PRESENTERS AND PARTNERS

Some classes, events, and offers are presented, instructed, or provided by third parties, including partners such as the United States Concealed Carry Association (USCCA). Those parties are independent of Camping Tools. They are responsible for their own content, instruction, products, and services, and their statements and opinions are their own and not those of Camping Tools. Third-party names, logos, and marks, including those of USCCA, are the property of their respective owners and are used with permission or as otherwise permitted by law.

OFFERS, COUPONS, AND PRICING

Offers, discounts, and coupons, including coupons given to class attendees, are subject to the terms stated with the offer. Unless stated otherwise, they have no cash value, are not transferable, cannot be combined with other offers, may expire, and may be changed, suspended, or withdrawn at any time. Any stated value of a class or offer is provided for comparison only. We reserve the right to correct errors in prices, descriptions, availability, or offers, to cancel any order affected by an error, and to limit quantities. An offer is void where prohibited by law.

INTELLECTUAL PROPERTY AND USE OF THE SITE

The site and its content, including text, images, graphics, logos, and software, are owned by Camping Tools or its licensors and are protected by copyright, trademark, and other laws. You may view and use the site for your personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, or create derivative works from the site or its content, or use automated means to extract data from it, without our prior written permission. You may not use the site unlawfully, interfere with its operation, or attempt to gain unauthorized access to it.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAMPING TOOLS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, PRESENTERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO THE SERVICE, ITS CONTENT, ANY CLASS OR EVENT, OR ANY PRODUCT OR THIRD-PARTY SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CAMPING TOOLS IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Camping Tools and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these notices or any applicable law, or your violation of any third party's rights.

GOVERNING LAW AND DISPUTES

These notices and any dispute arising out of or related to the service are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles. Except where applicable law requires otherwise, you agree that the state and federal courts located in Georgia have exclusive jurisdiction and venue over any such dispute, and you consent to the personal jurisdiction of those courts.

CHANGES, SEVERABILITY, AND OTHER TERMS

We may update these notices at any time by posting the updated version with a new “Last Updated” date. If any provision of these notices is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of it. These notices apply in addition to any other terms posted on or referenced by our site (such as terms of service); if they conflict, the more specific terms control.
